1. IMPORTANT INFORMATION

You should carefully read the following Terms and Conditions. Your purchase or use of our products implies that you have read and accepted these Terms and Conditions.

2. LICENSE

Our website grants you three possible types of license to use the web templates and other products (the "products") sold through our website by independent content providers in accordance with these Terms and Conditions (the "license") issued by our company, as follows:p>

a) ONE TIME USAGE LICENSE

You may be granted a One Time Usage License in case of purchasing a website template at a Non-Unique Price. It enables you to use each individual product on a single website only, belonging to either you or your client. You have to purchase the same template again if you want to use the same design in connection with another or other projects;

b) DEVELOPERS LICENSE

You may be granted a Developers License that entitles you to make some modifications with the products using any software or applications and our designs. You are permitted to redistribute or resell your projects after the receiving the license. You can apply for the license at ;

c) BUYOUT PURCHASE LICENSE

You may be granted a Buyout Purchase License in case of purchasing a website template at a Buyout Purchase Price. This type of license guarantees that you are the last person to buy this template. After the buyout purchase occurs, the template is permanently removed from our sales directory and is never available to other customers again. You can not redistribute or resell templates after Buyout Purchase Price.



3. IMAGERY, CLIPARTS AND FONTS

All imagery, clipart and fonts used in our products are royalty-free and are the integral part of our products. One Time Usage License and Developers License give you the right to use images, clipart and fonts only as a part of the website you build using your template. You can use imagery, clipart and fonts to develop one project only. Any kind of separate usage or distribution is strictly prohibited. All images and illustrations used in templates come in a single layer, as is.

4. MODIFICATIONS

If you have not received the Buyout License, you shall not place any of our products, modified or unmodified, on a diskette, CD, website or any other medium. You also shall not offer them for redistribution or resale of any kind without prior written consent from our company.

5. UNAUTHORIZED USE

We do not install any of our products which require installation (osCommerce templates, Zen Cart templates, etc.) Installation is a paid service which is not included in the package price.

6. ASSIGNABILITY

You shall not sub-license, assign, or transfer the any mentioned above to any entity without prior written consent from our company..

Our company reserves the right to change or modify these terms with no prior notice.

7. OUR REFUND POLICY

YOU WILL HAVE UP TO 14 DAYS TO RETURN ANY PRODUCT PURCHASE

WE SHIP USING USPS,UPS, FEDEX,

WE SHIP 1 TO 4 DAYS AFTER PAYMENT IS MADE TRACKING # WHEN ORDER SHIPS.

PURCHASE ORDERS   

● any additional or different terms or conditions set forth in any purchase order or similar communication are hereby rejected and shall not be binding or effective unless expressly assented to in writing by an authorized representative of Seller. Seller reserves the right to refuse purchase orders which may be submitted to it and will not be bound to fill any purchase orders unless or until they have been accepted by Seller. 

PAYMENT TERMS • Standard Terms

● NET 30 days from date of invoice 
● Invoice date corresponds with date of shipment. 
● Payment must be received on or before 30th day from date of invoice or 1.5% penalty accumulated will begin on day 31 

OTHER PRICING INFORMATION

● PRICES are subject to change without prior notice and are not guaranteed. All orders will be shipped at prices in effect at time of shipment. 
● PRICE CHANGES are effective on a specific date and all orders shipped on or after that date will be billed at the revised price. 

SHIPMENT QUALIFICATION TERMS

● No prepaid freight unless authorized

● Distributor/drop shipments OTShipping must be shipped to one location in the continental USA, per P.O. 
● Routing is of our selection. Any routing at the direction of the customer will be shipped freight “Collect” at the customer’s expense. 
● If backorders should occur, APS will contact the customer to revise or cancel backorder 

OTHER SHIPMENT TERMS 

● Upon delivery of shipments to the carrier, title to, and the risk of loss or damage in transit for, such shipments passes to Buyer. 
● Although risk of loss passes to customers upon our delivery of merchandise to the carrier, we will file freight claims as a service to them if we receive a written request from them within 10 days of invoice which includes: 
(1) a listing of those items short or damaged with supporting documents, 
(2) references to purchase order and invoice numbers, and 
(3) in the case of damaged goods, a copy of the carrier’s inspection report. 
● Orders will be filled to the extent of stock on hand and any balance forwarded as soon as possible. 
● Shipping schedules are estimates only which cannot be guaranteed because of the nature of Seller’s products and material, labor and manufacturing conditions beyond Seller’s reasonable control. Under no circumstances shall Seller be responsible for any inability or delay in meeting shipping schedules or for any loss or damage (whether direct or consequential) resulting there from. 

FREIGHT CHARGES (Rates Are Subject To Change Without Notice) 
● Premium Transportation (I.E. Air Freight, Dedicated Trucking, Etc.) that is utilized on any shipment at the customer’s request will be shipped freight “Collect” 
● Drop ship orders are subject to handling fee. Please contact your account manager for any questions regarding this service. 

OTHER TERMS • Returned Goods Policy 
● to be eligible for credit or exchange, goods returned to us by our distributors must comply with the following: 
1.Goods must be current models of cataloged items. 
2. Return must be authorized by our Returns Manager accompanied by an RGA number. All defective warranty returns must be sent to original manufacturer as it is a manufacturer’s warranty. 
3. Transportation charges must be prepaid. 
4. Goods must be shipped to the appropriate Distribution Center, refer to point 2. 

● Returned goods are subject to 15% re-stocking fee for the return of operational items in original unopened packaging.

SHIPPING:

 

Shipping is done on a Monday thru Friday Basis from 9-5PM EST. If your order is placed on Friday at 6PM your order will not be officially placed until that coming Monday and thus will then ship that following week. All orders are shipped using USPS,UPS,FedEx or Freight Direct, all orders placed on this web site will have a tracking/Delivery number emailed to the vendor.

Order Processing Time: 1-4 Business Days, Expedited orders will be charged a $7.50 fee (1 Day Processing)

Standard Shipping Delivery Time and Time in Transit  2-9 business days depending on carrier.

3-Day, 2-Day and Overnight Express shipping is available, You must contact us for a quote on each order for these shipping methods, Standard shipping is included in each drop ship price as shows. 

Signature Confirmation Services, Hold for Pickup, C.O.D. , and other shipping services are available upon request for an additional fee.

RETURNS/Re-Stock Fees:

 

You must email us at  to obtain a RMA# for all returns

RETURNS FOR ITEMS NOT WANTED: If an item is being returned to us because it is not wanted there will be a 20% re-stock fee and you must notify us in advance.

RETURNS FOR REPLACEMENT ON DOA/DAMAGED ORDERS: If an item is being returned because it was shipped DOA or was damaged during shipment you must email us to obtain a RMA number and state the reason of return. ***NOTE*** WE DO NOT GRANT REFUNDS FOR ANY ITEMS, THE ITEM WILL ONLY BE REPLACED/EXCHANGED, WE DO NOT ACCEPT ANY ITEM BACK FOR A FULL REFUND ONLY EXCHANGES ON DOA/DAMAGED ITEMS. IF YOU DO NOT WANT THE ITEM REPLACED THE 20% RESTOCK FEE EXISTS.

Bad Shipping addresses or Undeliverable as addressed Returned to sender parcels will be refunded to your Vendor account (no cash value) and a 20% re-stock fee charged.

RMA's are Valid only for 30-days after the order is placed.

8. OWNERSHIP

You do not claim intellectual property right or exclusive ownership to any of our products, modified or unmodified. All products are property of independent content providers. Our products are provided "as is" without warranty of any kind, either expressed or implied. In no event shall our company or its agents be liable for any damages including, but not limited to, direct, indirect, special, punitive, incidental or consequential, or other losses arising out of the use of or inability to use our products.

9. INSTALLATIONS

We do not install any of our products which require this (osCommerce templates, Zen Cart templates, etc.). Installation is a paid service which is not included in the package price.

10. ANTIFRAUD CHECK

Customer purchase can be suspended for manual antifraud check for 10-20 minutes as well as it can be suspended for a longer term for more serious investigations. Antifraud check occurs because of growing number of fraud transactions from persons who are not actual cardholders of the credit cards used during purchase.

11. THIRD-PARTIES SERVICES

We may use third parties to provide certain services accessible through the website. Our website does not control these third parties or their services, and you agree that our company will not be liable to you in any way for your use of such services. These third parties may have their own terms of use and other policies. You agree to comply with such terms and policies as well as these. If any such terms or policies conflict with our terms, agreements or policies, you must comply with those of our website.

12. INFORMATION DISCLOSURE

You may not disclose any order information including, but not limited to, Order ID, download link, etc.
